What a Florida speeding ticket is

A Florida speeding ticket handed out by an officer is typically a Uniform Traffic Citation (UTC) for unlawful speed under chapter 316. It is not the same paper as a Florida camera Notice of Violation under the red-light or school-zone camera statutes. Camera mailings start as an NOV and can later become a UTC if unresolved; those clocks and no-point rules are different. Officer-issued unlawful speed (do not mix with camera statutes)

Florida Statutes 316.183 (2026, retrieved 11 Sep 2026): no person shall drive a vehicle on a highway at a speed greater than is reasonable and prudent under the conditions; a violation of this section is a noncriminal traffic infraction, punishable as a moving violation as provided in chapter 318. That is the statute’s statement.

Civil penalty amounts for unlawful speed (Fla. Stat. § 318.18)

Florida Statutes 318.18(3)(b) (2026, retrieved 11 Sep 2026) states fines for moving violations involving unlawful speed as follows (speed exceeding the limit by):

1–5 mph — Warning; 6–9 mph — $25; 10–14 mph — $100; 15–19 mph — $150; 20–29 mph — $175; 30 mph and above — $250.

Florida Statutes 318.18(3)(c)–(h) (2026): school-zone, construction-zone, enhanced-penalty-zone, and toll-facility doubling or add-ons are stated in those paragraphs (for example, school zone or designated school crossing — double the paragraph (b) amount, with a $50 fine for up to 5 mph over in a legally posted school zone). Court costs and other add-ons appear elsewhere in 318.18. That is the statute’s statement, not an instruction from us. Points under Fla. Stat. § 322.27 (officer path)

Florida Statutes 322.27(3)(d)5. (2026, retrieved 11 Sep 2026) — Unlawful speed:

a. Not in excess of 15 miles per hour of lawful or posted speed — 3 points.

b. In excess of 15 miles per hour of lawful or posted speed — 4 points.

c. Points may not be imposed for a violation of unlawful speed as provided in s. 316.1895 or s. 316.183 when enforced by a traffic infraction enforcement officer pursuant to s. 316.1896 (camera / TIEO school-zone path). That no-point clause is for that TIEO path only — not for a typical officer-issued UTC.

Florida Statutes 322.27(3)(d)3. (2026): unlawful speed resulting in a crash — 6 points.

Florida Statutes 322.27(3) (2026): the department may suspend for accumulating 12 or more points; 12 points within 12 months — suspension not more than 30 days; 18 points within 18 months — not more than 3 months; 24 points within 36 months — not more than 1 year. Florida Statutes 322.27(4): the department uses the offense date of convictions when computing points and suspension periods. That is the statute’s statement. UTC timing and paths (FLHSMV / 318.14)

FLHSMV Traffic Citations (retrieved 11 Sep 2026): customers issued a Uniform Traffic Citation have the option to pay the citation, contest the citation, or take a driver improvement course; customers have 30 days to make this election with the clerk of court listed on the citation; failure to elect within 30 days may result in additional fines along with suspension of the driving privilege. Payment of the civil penalty is considered a conviction and points will be assessed if applicable. That is FLHSMV’s statement, not an instruction from us.

Florida Statutes 318.14(4) (2026, retrieved 11 Sep 2026): except as provided in subsection (12), any person charged with a noncriminal infraction under this section who does not elect to appear shall, within 30 days after the date of issuance of the citation, pay the civil penalty and delinquent fee if applicable (by mail or in person), or enter into a payment plan with the clerk; following those procedures is deemed an admission of the infraction and a waiver of the right to a hearing. Florida Statutes 318.14(8): when a report of a determination or admission is received, the department enters the proper number of points under s. 322.27. Florida Statutes 318.14(9) (2026) and FLHSMV: for eligible noncommercial drivers cited while driving a noncommercial motor vehicle, a basic driver improvement course election may be available (with stated exclusions, including when the driver exceeds the posted limit by 30 mph or more under listed speed statutes); adjudication withheld, civil penalty under 318.18(3) reduced by 18 percent, and points under 322.27 not assessed, subject to the election limits in that subsection.
